1. Introduction

Welcome to U-Solar SA ("U-Solar"). By accessing or using our website and purchasing our products, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or purchase our products.

2. Entire Agreement

The Terms and Conditions as set out represent the entire agreement between the parties. No alterations or additions may be effected unless agreed to by both parties, reduced to writing, and signed by you and a duly authorized representative of U-Solar SA. These terms and conditions are final and binding and are not subject to any suspensive or dissolutive condition.

3. Changes to Terms & Conditions

These terms and conditions are subject to change, and you agree that any order placed shall be subject to the terms and conditions in force at the time the order was placed.

4. Use of the Website

By accessing our website, you agree to:

  • Use the website only for lawful purposes.

  • Not engage in any conduct that restricts or inhibits any other user from using or enjoying the website.

  • Not attempt to gain unauthorized access to any part of the website, other accounts, computer systems, or networks connected to the website.

  • Not use the website in any manner that could damage, disable, overburden, or impair the website or interfere with any other party's use of the website.

5. Products and Services

  • Product Descriptions: We strive to ensure that the products on our website are accurately described. However, we do not warrant that product descriptions or other content is error-free.

  • Pricing: All prices listed on the website are subject to change without notice. Prices do not include any applicable taxes or shipping costs.

  • Orders: We reserve the right to refuse or cancel any order at any time. If your order is canceled, we will notify you and refund any payments made.

6. Quotations

All quotations will remain valid for a period of 7 (seven) days from the date of issue.

7. Payment Options & Terms

The following payment methods will be accepted by U-Solar SA:

  • Electronic Funds Transfer (EFT)

  • Debit Card payments

  • Note: No cheque payments or cash deposits will be accepted.

 

Payment for products ordered is due prior to shipment and needs to be cleared in our account.

8. Placing of Orders

Prior to placing your order, please ensure that the goods ordered are suitable for the purpose of intended use. Should any uncertainty arise as to the suitability of a product, please contact our offices for assistance prior to placing your order.

​

All U-Solar products supplied must be installed in accordance with the manufacturer's specifications, South African laws, and by a qualified electrician with a wireman's license or Master electrician with a valid registration with the Department of Labour. A valid electrical Certificate of Compliance (COC), not older than 2 years, must be provided upon which a Supplementary COC will be issued once installed, specific to the installation of the backup or solar system.

Installation of a solar system or backup power system and all required parts must be compliant with SANS 10142, NRS 097-2-1, SANS 62930, SANS 10199, and SANS 10313 regulations.

​

Warranty claims will be subject to a valid premise COC, Supplementary COC, before photos and installation photos, proof of installation electrician wireman’s license/master electrician qualifications which can be rejected and render the warranty null and void if not received.

No order will be binding on U-Solar SA until it has been accepted by its management.

​

9. Pricing

Price, specifications, and terms are subject to change. You are therefore requested to peruse the prices, specifications, and terms prior to placing any order. The purchase price will be the current price as appearing on U-Solar SA's website (www.u-solarsa.com).

Any increase in the cost of the products prior to delivery, or if any additional taxes or duties are levied or laws are promulgated that directly or indirectly increase the cost thereof to the company, the company shall be entitled to increase the price of the goods by an amount equal to such increased cost, by giving you reasonable notice thereof.

​

10. Change of Orders

All orders and change orders are subject to these terms and conditions. Only written orders and change orders will be accepted by U-Solar SA. No telephonic orders will be accepted. U-Solar SA reserves the right to refuse delivery or collection of any order until placed in possession of a written order form.

11. Cancellation of Orders

Requests for cancellation of an order, prior to delivery, must be submitted in writing to info@u-solarsa.co.za.

No refunds will, however, be furnished on deposits or payments in the event of cancellation for special ordered or manufactured goods.

Should the goods ordered become unavailable due to any cause beyond U-Solar SA’s reasonable control, such order will be subject to cancellation by U-Solar SA.

12. Processing Times Policy

Order processing will be done between two to five business days, depending on stock availability and payment verification. Same-day shipping can therefore not be guaranteed by U-Solar SA. Please note that no orders will be processed on weekends and official public holidays.

​

13. Back Orders

Any delays in obtaining/delivering any products ordered will be communicated by U-Solar SA. The unavailable order will be placed on backorder, and the remainder of the order placed will be shipped.

​

14. Guarantees and Warranties

To the extent allowed by law, and notwithstanding any other provision of this agreement:

  • Any goods supplied by the company shall be subject to the manufacturing company’s warranty.

  • All goods and items are to be returned to U-Solar SA at HYGE Room 1201, 12F, Bedford Centre Office Tower, Smith Road, Bedford Gardens, Bedfordview 2008, Gauteng, South Africa, at the customer’s expense.

  • We do not offer any off-site warranty services.

 

The warranty shall immediately be rendered null and void in the event of any of the following:

  • Failure to use the products in accordance with instructions and specifications provided by the Manufacturer.

  • Should the product have been subjected to physical damage, abuse, misuse, alteration, neglect, tampering, improper maintenance, or has been serviced, repaired, installed by persons not possessing the necessary qualifications required to do so.

  • The product is not returned with an invoice/verifiable method confirming proof of purchase.

15. Returns

Please refer to our Refunds and Returns Policy. You may return goods in the following instances:

  • Within 7 (seven) days of the date of the receipt of the goods if the transaction falls within the scope of Section 44 of the Electronic Communications and Transactions Act. The aforementioned return policy excludes items contemplated in Section 42(2) of the aforementioned Act.

  • Within the implied warranty period if the product is defective according to the manufacturer's warranty.

  • Within 14 (fourteen) business days, if U-Solar SA has wrongly supplied goods off a written order.

 

Notwithstanding the above, U-Solar SA shall not be required to accept the return of any goods, unless defective within the warranty period, if at your direction, the goods have been:

  • Partially or entirely disassembled.

  • Physically altered.

  • Permanently installed, affixed, or attached.

  • Joined or added to or blended or combined or embedded within other goods or property.

 

16. Returns Procedure

U-Solar SA will not accept the return of any product without prior authorization and a confirmation return number issued by U-Solar SA.

 

Customers agree to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. You are required to bear the cost of shipping and insurance required for the return of the goods to U-Solar SA. U-Solar SA will not refund shipping charges, unless an error in delivery was made by U-Solar SA.

 

Customers agree that all returned products for credit, replacement, or refund will be 100% complete, in a resalable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer.

 

There shall be a 25% return charge (as per supplier/manufacturer charge) for returns due to the order being the fault of the consumer.

 

If any component of the returned product is missing, U-Solar SA will refuse to accept the return or may impose additional charges against you for the replacement of the missing component.

 

U-Solar SA may impose a reasonable fee should it be necessary to restore the goods in order to render them suitably fit for re-stocking.

17. Repairs

No repairs will be handled by U-Solar SA. All manufacture defaults will be handled directly by manufacturers or their appointed agents.

 

U-Solar SA shall not be liable for any loss or damage of whatsoever nature which you may suffer as a result of any unforeseen costs and/or delayed repairs done by manufacturers.

 

U-Solar SA will lodge any complaint and place you in contact with the manufacturer to process the repair work or replacement of any product that was purchased through U-Solar SA.

 

All costs for shipping to the manufacturer will be at the client’s expense should the manufacturers not offer a call-out or free shipping policy to cover the expense.

 

18. Limitation of Liability

To the extent allowed by law, you agree that U-Solar SA shall not be liable to you or any other person or entity whatsoever in respect of any loss or damage:

  • Caused by or arising from any fact or circumstance beyond the reasonable control of U-Solar SA.

  • Which is consequential or incidental loss or damage.

  • Of whatever nature and howsoever arising from or in connection with the supply of goods.

 

19. Encouragement to Insure Installations

We strongly recommend that customers include their solar or backup power installations in their home insurance policies. Please note that insurance coverage will not be valid without a current and valid Certificate of Compliance (COC).

20. Service Address and Notices

For all purposes under this agreement, including giving any notice, payment of any amount, service of any process, and for all other purposes arising from this agreement, you hereby choose the service address set out on the quotation for the order of goods.
